About Stuart

Love getting to the heart of clever inventions, protecting them, and seeing them develop into successful features or products.

Stuart specialises in utility and design patents in the information and communications technology (ICT) sector. This includes working with Australian and international businesses whose primary operations are SaaS, electronic devices, GUIs and related technologies, cloud computing, computer engineering, and eCommerce.

Stuart has significant experience working with these clients to build their patent portfolios, including invention capture, drafting, prosecuting patent and design applications, and overall portfolio strategy.

Stuart has substantial expertise when it comes to advising on validity and infringement matters. He also excels in supporting patent and design litigation, and played a central role in one of Australia’s largest patent and design litigation matters.

Drawn to the patent attorney profession as it offered a career where he could make use of both his Law and Computer Science degrees – and more importantly, he could engage with technology and clever scientists and engineers on a daily basis – Stuart takes pride in having worked with some of the most successful and innovative technology companies across the globe. He takes a practical approach, always looking to understand his clients so he can identify how to best provide value to their businesses.

Stuart is a Co-author of the Australia chapter of the 2nd Edition of the Wolters Kluwer text “Industrial Design Rights: An International Perspective”, and a repeat presenter at the American Intellectual Property Law Association Design Rights Boot Camp.

Irvine’s knowledge of Australian law, attention to detail and quality of communication are all elite.

He has great skill prosecuting patents through the Australian Patent Office, as well as excellent insight into the differences between US and Australian practice (and the similarities) that might lead to similar or dissimilar outcomes in the two countries. This in turn allows Stu to provide expert advice regarding prosecution strategy.
